Christopher Raleigh was the longtime law partner of John Hunt, former Clark County district attorney's office candidate. Mr. Raleigh passed away in a car accident in Vermont on January 16, 2012. Also killed was his young son. Injured was his wife. Neither he nor his wife were wearing seat-belts according to the news. The driver and passengers of the other car apparently were not injured much. Mr. Raleigh has been a lawyer in Las Vegas since 1982. The Wright Law Offices has no affiliation with Mr. Raleigh, but we respect a hard-working attorney and offer condolences to his family.

Judges and Temperament

Certain judges in Clark County lecture attorneys at Continuing Legal Education seminars on how to behave in court and how to conduct their cases. Many attorneys require this instruction and I will not discourage it in this article. However, some judges need to take to heart the proper behavior expected of a jurist.

Too many judges treat litigants and attorneys disrespectfully. Some judges do not know the law or the facts well enough before they render an order. Some judges, or their staff, make mistakes by losing or ignoring paperwork leaving the lawyers to face their clients and clean up the mistakes.

Let's face it; some judges should simply not be judges. I cannot name names, but some judges should be disrobed--even if we may fear what lie beneath.

The judges who really want to be looked upon favorably by the voting public (and the deciding votes are probably the lawyers that appear before them) should consider and implement the following suggestions:

1. Sometimes the lawyers/litigants with money behind them are not nearly as powerful as the poor lawyers/litigants with the voting church congregations behind them.

2. "Endorsement by Metro" insinuates trampling on civil rights or always favoring a police officer witness or litigant over a civilian.

3. "Endorsement by businesses" suggest no justice for injured guests or patrons of business establishments in civil actions.

4. A "no nonsense" demeanor in court intimidates the truthful and candid more than it does the liars and cheats (who are used to being suave). This results in favorable rulings to sociopaths that can lie to your face over nervous people that are intimidated by the process, but truthful. Be nice to everyone but study the testimony critically. Judge Judy is fine for entertainment--not justice--be more like the dignified Judge Wapner.

5. If there is even the slightest chance you, the judge, do not fully comprehend the law on a matter, it is better to take the matter under advisement until you do, than to trample on a litigant's rights through ignorance. We understand that parties want swift justice and opinions, but not at the sacrifice of common sense and the spirit and letter of the law.

6. A judge should never rule wrongly against someone based on the judge's thought that the person cannot afford to appeal. Appeals are too expensive for most. Asking friends and relatives to vote you off the bench in a recall or election is cheaper than appealing, in many instances. It also paves the way for other lawyers to run against you. I have heard it more than once in casual conversation, “I’m running against that judge because anyone, even me, is better.”

7. Embarrassing a lawyer in open court in front of his or her clients is going to engender hatred. The proper thing to do is to call a quick sidebar and speak privately to a lawyer regarding the lawyer's conduct in court, not to order the lawyer in open court to sit down and be quiet. (This applies to hearing masters, commissioners, judges, and anyone in a judicial capacity). Sometimes a lawyer is posturing for the sake of the client, not for the sake of earning money. Sometimes the other side has to know that they are up against an advocate who will not allow abuse to continue. When a judge silences this advocacy, the judge could be seriously negatively affecting a just settlement. Not all lawyers who are forceful in court are so because they are getting paid to be, some actually believe in their cases, clients, and justice.

8. Judges who scowl and treat those before them as though they have no dignity deserve no dignified respect in return. Judges can be rude and then utilize contempt power if a lawyer stands up against it. Judges who act rudely besmirch the entire justice system and grow antipathy against it. Such bad apples should voluntarily step down or undergo an attitude adjustment.

9. Judges engaged in sexual relationships with the lawyers that appear before them create a perception of bias and the community should not tolerate it.

10. Judges should have no financial interests in the consequences of their rulings. This goes beyond merely ruling based on potential election results and includes ruling when the judge, or the judge’s friends and family, own interests in businesses that can be affected by a decision.

Grandparents and other nonparents are typically not entitled to visitation with a minor child as a matter of right because there is a recognized presumption that a parent’s desire to deny visitation is in the best interest of the child. However, pursuant to NRS 125C.050, a grandparent or other nonparent may be granted judicially approved visitation rights in some instances. The first issue presented in this appeal is whether the stipulated visitation order between a parent and a grandmother was a final decree entitled to res judicata protections. The Nevada Supreme Court concluded that it was, so we must next examine whether the parental presumption continues to apply when a parent seeks to modify or terminate a nonparent’s judicially approved visitation rights with a minor child. We conclude that the parental presumption applies at the time of the court’s initial determination of a nonparent’s visitation rights. However, when, as in this case, a parent seeks to modify or terminate the judicially approved visitation rights of a nonparent, the parental presumption is no longer controlling.

District Court that definitively declares, at least for now, that when both parents and the child leave the State of Nevada to live elsewhere, Nevada loses its exclusive and continuing jurisdiction to decide matters for the family. Prior to November 23, 2011, legal minds differed on this, but now it is certain that the new court to decide matters is where the child takes up home-state residence.

This is not an easy “yes” or “no” answer and anyone who has a child out of wedlock should consult an attorney as soon as possible. Below are a number of reasons why the question is hard to answer:

· At birth, it is clear who the mother is, but the father may not be clear.
· If a man knows himself to be the father, he can voluntarily establish his paternity by signing a “declaration of paternity”.
· If a father does not declare his paternity, he may actually be the father, but no one can be sure until he establishes it via court order.
· However, if the father was married to the mother either during the pregnancy, or shortly thereafter, his paternity is presumed.
· Now, if the father asserted his paternity or his paternity is presumed, then the father has equal rights to the mother until a court order says otherwise.
· However, if the father has not asserted his rights by signing a declaration of paternity at the time of birth, or marrying the mother, or getting a court order establishing paternity, then he is not a “parent” under the law and he cannot assert his parental privileges.
· If the father did not assert his paternity, then the mother has primary physical custody by operation of law—and the mother can pretty much do what she wants as far as raising the child until a court order says otherwise (including moving out of state, etc.)
· If, however, the father established his paternity, even if the mother gets primary custody, the mother is restricted from violating the father’s rights and cannot do as she wants without risking punishment from the courts.

New Nevada Traffic Law About Cell Phones and Driving

Here are some important new traffic laws passed by the 2011 Nevada Legislature. A short description of each is followed by its effective date, legislative bill number and applicable Nevada Revised Statute or NRS Chapter.

No Texting and Hands-Free

Texting, accessing the internet and hand-held cell phone use while driving are now illegal in Nevada.

You can talk using a hands-free headset and, while making voice calls, touch the phone to “activate, deactivate or initiate a feature or function on the device.”

The fines are $50 for the first offense in seven years, $100 for the second and $250 for the third and subsequent offenses. Fines are subject to doubling if the offense occurs in a work zone. The first offense is not treated as a moving violation for DMV and insurance purposes.

Exceptions include:

• Any person reporting a medical emergency, a safety hazard or criminal activity.

• Drivers using a voice-operated navigation system affixed to the vehicle or those riding in autonomous vehicles.

• Drivers using citizen band or other two-way radios that require a license and have a separate, hand-held microphone.

• Law enforcement officers, firefighters or emergency medical personnel acting within the scope of their employment.

• Utility workers responding to an outage or emer- gency and using devices provided by the company.

• Amateur radio operators providing communications services during an emergency or disaster.

OBTAINING CHILD CARE WITH INTENT TO DEFRAUD

NRS 205.870 Definitions. As used in NRS 205.880 and 205.890, unless the context otherwise requires:
1. “Care” includes board, laundry, lodging, teaching, incidental materials and supplies, necessary articles of apparel or clothing and necessary medical, nursing or hospital service for which a child care establishment is liable.
2. “Child care establishment” includes any children’s home, day nursery, kindergarten, nursery school or other similar establishment however designated, maintained or operated for the care of children for compensation or hire.

NRS 205.880 Obtaining care for child in child care establishment with intent to defraud keeper or proprietor; penalty; exception.
1. Any person who obtains care for any child in any child care establishment with intent to defraud the keeper or proprietor of that establishment is guilty of a misdemeanor.
2. This section does not apply where there has been an agreement in writing for delay in payment for a period exceeding 10 days.

NRS 205.890 Prima facie evidence of intent to defraud. The obtaining of care for a child in a child care establishment by means of any false pretense or representation, knowingly made, or the refusal or willful neglect to pay for that care, or the giving in payment for that care of any negotiable paper on which payment is refused, or the removal of a child from such an establishment without paying or offering to pay for the child’s care, or the surreptitious removal or attempt to remove a child from that establishment, is prima facie evidence of intent to defraud the keeper or proprietor of that establishment.

Do automatic stays in bankruptcy court stop legal actions in divorce court?

Automatic stays in bankruptcy court stop all legal action against debtors for their pending debts. However, when a divorce case and bankruptcy case are pending at the same time, the issues can become more complicated. The complications especially arise when the bankruptcy court has to determine which property is dischargeable and which is non-dischargeable for the debtor to fulfill his/her domestic obligation during and after divorce.

Traditionally, bankruptcy stay orders imposed a restriction on collecting alimony, child support and other domestic liabilities from the property of the estate. However, with the initiation of the Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCA) some exceptions have been included within the law. If the property is non-estate then those above mentioned obligations have to be fulfilled by the debtors from that property.

Under United States Code § 362(b) (2), the exceptions of Stay order on divorce related collection are enunciated and expanded by BAPCA. According to this code, the commencement and continuation of a divorce case is permitted. The dirorce judge can establish paternity, can modify domestic support obligation and can even dissolve a marriage. However, division of property can be done only if it is not an estate property. If any non-filing spouse tries to get an equitable division of property, such an attempt may also be dismissed by the automatic stay order. If the non-debtor party takes action in the state court to effectuate one of the above exceptions, the debtor can take recourse in the provision contained in §105. With this provision the bankruptcy judge can mobilize the stay order and cease the continuation of state court action.

If the ex-spouse raises claim of the past dues of alimony, the automatic stay order may nullify that claim. The state court cannot collect those alimony arrearages without obtaining express permission of the bankruptcy court.

Now let me point out the implications of chapter 7 and chapter 13 bankruptcies.

The money one earns after filing chapter 7 bankruptcy will be deemed to be property that qualifies as collectible 'post petition earnings'. You will be obligated by the rule of law to fulfill all your monetary obligation by using this money.

But the money you earn after filing a chapter 13 petition will be included in your bankruptcy estate. Therefore, this will not be sanctioned for the payment of arrearages of domestic support while the stay order. Only after obtaining legal order from Bankruptcy court one can get monetary support from his spouse.

Beware of Police Citing for Failing to Yield to Emergency Vehicles

In Nevada, while driving, when a police officer signals behind you, you must immediately pull over to the right. In Las Vegas and Henderson, cops are recently citing people for not immediately pulling over to the right even when doing so is dangerous. Then, on top of the original citation that caused the cop to stop the person, the cop cites for failing to yield to an emergency vehicle.

I believe this is a scam. The fine is over $1100, and even after negotiating the fine, it is only reduced to $255--in addition to the fine for the original offence(s). Beware. Never have a cop behind you if you can avoid it, and always get over to the right if you see one behind you, just in case.

The worst thing to do if stopped, is to argue with the cop. They can arrest you on the spot

Malik, the Nevada Supreme Court determined that family court judges have the power to hear other types of cases besides family cases, however, only family court can hear family court cases. Also, once a default has been entered but the defaulted party secures an extension of time, a new notice of intent to default must be sent to that party if they again fail to timely respond:

Accordingly, because we conclude that a family court judge maintains all the constitutional powers of a district court judge, we hold that the family court judge did not lack judicial power or authority to consider the substantive and procedural aspects of Malik’s complaint and enter judgment in this case. Nonetheless, we reverse the default judgment because the district court abused its discretion in upholding the default judgment when Malik did not serve Landreth with proper notice of his intent to seek default after granting Landreth additional extensions to file an answer.

What this basically means is that couples that lived together but never married can have a family court judge help decide the property division even though it would not be considered a family case since there was no marriage.

Don't be a Knight in Shining Armor

Some men have a fatal flaw. They look for damsels in distress to save. They want a relationship with women that will depend on them because they feel inadequate, are lonely, or have some manhood problem for which they feel they must compensate (ie. their mommies emasculated them somehow).

Most men naturally want to be protective and chivalrous. Some take it too far and look for broken women which only results in broken relationships. Men who build relationships on the need to be needed doom themselves to failure.

Why?

Two reasons: 1. If the woman never gets better and always remains distressed, the man will always have a less than adequate mate. There will never be equality and rapport. 2. If the woman gets better as a result of the man's efforts, she may realize how inadequate he was to be with her in the first place and then leave him for greener pastures.

It is a no win situation.

As a divorce attorney, I have seen this scenario play out all too often. Note, the roles could easily be reversed with the same consequence. Women will latch onto less than adequate men in the hope that their love will change the bad boy. All too often they are wrong and end up with bitter disappointment.

Mr. Cavell divorced Mrs. Cavell but there was no mention of alimony in the divorce decree. Twenty-two months later, Ms. Cavell returned to court seeking alimony and increased child support. The judge said "no" to both so she appealed. In 1974, the Nevada Supreme Court published it's decision, declaring the judge was right and wrong. As for alimony, he was right. She had to seek it during the divorce proceedings. As for child support, the Supreme Court ruled that the judge abused his discretion because child support is modifiable after a divorce. This 36 year old opinion is still good case law authority in Nevada.

Actually, if you live or get a ticket in Clark County, Nevada, having a lawyer assist you with it makes way more sense than handling it on your own. You might be thinking that I am just saying this because I am an attorney and want your business. Well, yes and no. Yes, I am an attorney and I want your business, but even if I wasn't, knowing what I know, I would still recommend that people have lawyers handle their traffic tickets. Some of the reasons are listed as follows:

--Attorneys get preferential treatment at court. Our wait in line is shorter, we get through the metal detectors faster, and we know where to park and how much we have to feed the parking meters.
--Non-attorneys often will go to court, have to take their shoes and belts off before being allowed into the courthouse, will have to wait for one to four hours for their number to be called at a window only to be told that the ticket is not in the system yet and they will have to come back another day. Then, when they go out to their car, shaking their heads that they wasted a vacation day to deal with this, they find that they have a parking ticket on their windshield because the meter expired while they were waiting in line for nothing.

--Attorneys often get the tickets reduced to non-moving violations without points on the driving record and no traffic school.
--Non-attorneys pay the full fine at the window, get points on their driving record, and will have to take traffic school (which costs money and takes hours of time) in order to get the points removed from the driving records. --Attorneys know the court staff and judges and are more comfortable talking to them and getting results.
--Non-attorneys are frustrated at the whole process and show their contempt to the staff and judges causing only more grief for themselves. (There is an old saying that only a fool represents himself in court).

--Attorneys get a traffic citation (which is a criminal charge) reduced to a non-criminal charge.
--Non-attorneys pay the fine on the criminal charge, resulting in a criminal conviction.

1. The parent and child relationship extends equally to every child and to every parent, regardless of the marital status of the parents.

2. Except as otherwise provided in a court order for the custody of a child:

(a) Except as otherwise provided in paragraph (b), the mother of a child born out of wedlock has primary physical custody of the child if:

(1) The mother has not married the father of the child; and

(2) A judgment or order of a court, or a judgment or order entered pursuant to an expedited process, determining the paternity of the child has not been entered.

(b) The father of a child born out of wedlock has primary physical custody of the child if:

(1) The mother has abandoned the child to the custody of the father; and

(2) The father has provided sole care and custody of the child in her absence.

3. For the purposes of this section, “abandoned” means failed, for a continuous period of not less than 6 weeks, to provide substantial personal and economic support.

4. As used in this section, “expedited process” has the meaning ascribed to it in NRS 126.161.

Many child custody cases nowadays are handled diplomatically. The parents agree on all or most of the issues and therefore do not go through lengthy (and costly) court battles. The other reward for this is a healthier relationship with the children since they do not have to witness their parents constantly battle over every little issue that arises. It is an unhappy statistic, but a lot of sexual relationships do not last, regardless whether a couple has children.

One of the greatest examples of diplomatic resolutions is those couples who intelligently draft parenting agreements and get court orders ratifying the agreements BEFORE they split up. This is especially wise for couples with children who have not yet married. If the relationship does fail, then the Father has no rights to the children until he establishes paternity and acquires a custody order through court. Often, this means getting a paternity test, which of course, costs money. If the couple waits until they are angry at each other to finally get custody orders in place, then that potentially means the issues may not get resolved without a lengthy, costly court battle.

Married couples can benefit from a proactive approach as well. Divorce is much more costly than drafting a prenuptial or postnuptial agreement that anticipates child custody. Although a court may not later be bound to follow the agreement, the agreement will be a persuasive document outlining the intent of the parties. All the issues that are fought over in a divorce may have the couple angry and bitter towards each other for many years. This means that the child custody portion of the divorce could potentially be a volatile battle resulting in a trial. There is no “winning” in Family Court though. The children always lose in a big drawn out battle. An agreement prepared while the couple is still happy should be kept along with other important documents, including birth certificates, immunization records, wills, and, trusts.

Prenuptial agreements and postnuptial agreements need not necessarily anticipate a divorce. No one that is happily married wants to go to their spouse and say, “We need a postnuptial agreement because statistically we may get divorced.” There are other good reasons for a postnuptial agreement besides divorce. Outlining the intent of the parties in a document when both parties are of rational mind can assist in numerous ways should one spouse lose rationality for whatever reason, including accidental brain trauma, drug addiction, insanity, etc. A postnuptial agreement may serve as the parties’ intent for the children when that party can no longer formulate intent due to brain damage. Thus, a postnuptial agreement, will, trust, and other related documents are drafted out of love, primarily—not out of an anticipation of a hateful separation.

So be proactive! Get custody orders put in place whether or not you THINK you may never split up with your significant other. You make plans for your children’s future anyway right? These plans should be among those you make because there really is no telling what the future holds. If you make these plans while both of you are happy with each other than that is the ONLY way to ensure you will actually do what is in the best interest of your children. This proactive approach will save you time and money if something should happen. Couples who ARE able to do this show a great deal of promise in their relationship, it shows each other that you are willing to work things out and shows the great love you have for your children.

What is the best way to get judges to be judges?

Former US Supreme Court Justice Sandra Day O'Connor came to Vegas a week ago to speak about how best to get judges on the bench. She has been touring the country speaking about this issue. You see, she does not think that voting for judges is a good idea. I agree for the following reasons:

--When you vote for a judge, you may not be voting for the right reasons, such as competence and reasonableness, instead you may vote because of a negative ad or name recognition.
--Judges have to beg for support when they campaign, not something we want people who are supposed to be impartial to do because then they may feel they owe favors. (i.e. judges that always side with cops because they need the cop vote at election).

On the other hand, it is nice to vote people out of office who are horrible. Nevada will be voting on a proposition (Ballot Question 1) in November that gives us the best possible judges. The candidates for judge go through a huge interview process. Three of the candidates are then proposed to the governor who must select one. At the next general election, the public can vote to either retain the judge if the judge was good, or kick him/her off the bench.

This is probably the best way to ensure fairness on the bench and to keep the creeps off!

I was born in Vegas. Growing up, I did not know much else, and as a teenager, I wanted so much to be elsewhere. Even so, I decided to go to college at the University of Las Vegas, Nevada and then to law school at William S. Boyd, eventually to becoming a practicing attorney handling family law, criminal, and other civil legal issues.

Over time, I have traveled far and wide. I have been all over the United States and Europe, staying in Wisconsin, California, Washington, Utah, Arizona, and New Mexico. I have lived in Italy, Switzerland, Austria, and France for short periods. All very nice to visit, but Las Vegas is home.

Las Vegas has a great climate except for a few months during the summer. Even then, it is dry and one can use evaporative cooling, which is energy efficient. Las Vegas is in a valley and the surrounding mountains give a comforting security. Unlike many large cities, one can go up on a hill and see all the boundaries of the metropolitan area. At night is sparkles better than other cities.

To be sure, Las Vegas needs work in certain areas, but I cannot be too critical. For instance, Las Vegas is supposed to have one of the worst education systems in the country, but I had all my schooling here and do not think it is worse than elsewhere. To be fair, however, illegal immigrants have taken over a lot of the schools, making education seem worse due to lower test scores and difficulty in finding qualified bilingual teachers.

Las Vegas is considered one of the fattest cities. Cheap buffets and a desire to stay indoors over the summer may contribute to this, however the climate is so nice and there are many opportunities for outdoor activities in the morning before the heat hits. Hiking, cycling, skiing, and kayaking are all very doable activities. Moreover, we have great stores with good quality food such as Wholefoods, SunFlower Markets, etc. and buffets can be easily avoided. It only takes seeing nasty men in men's rooms wiping their butts, not washing their hands, and then standing in the buffet line ahead of you to gross you out on buffets. Imagining the fecal matter on the buffet tongs and forks...well, you now have a vivid mental picture that should be effective.

Las Vegas has a high unemployment rate right now--14.5%, but that is due in part to the transient nature of the city and the silly people who bought houses they could not afford during the real estate bubble. The largest industries in Las Vegas are construction and gaming/resort. Construction slowed because of the bursting of the housing bubble and gaming has been affected by the entire US economy and President Obama stating twice that businesses should not hold conventions here--businesses should sacrifice more and not go to Vegas. Great advice from a man who has his wife take sixty plus people on a European vacation mostly on the tax payer's buck.

All in all, Las Vegas has a bright future and is an excellent place to live. It offers many choices in relaxation, education (ie. dental school, law school, and trade schools), entertainment, sport, and real estate is once again at an affordable low. People should be returning to Vegas to take advantage of the low real estate prices fairly soon, probably in a year. Las Vegas will grow at a slower more manageable rate because it is such a nice place to be.

In order to relocate from the State of Nevada with your child, you should have primary physical custody. The law then requires consent from the other, noncustodial, parent. If the other parent does not provide written consent, then it is advised to hire an attorney to initiate court proceedings. The court will look at the reason for moving. If the reason appears to be in good faith and not intended to deprive the other party of visitation, then the court looks at the next test: the best interest of the child. "Richard, a 29-year-old from London, England, died from what appeared to be an excessive consumption of alcohol and drugs while he was vacationing in Las Vegas for a bachelor party. Following his death, his body was transported to the Clark County Coroner for an autopsy, where the county coroner removed the internal organs for examination. The county coroner contends that the organs were then placed in a plastic bag between Richard’s legs, and that after the autopsy was complete, Richard’s body and its internal organs were sent to the mortuary. After the mortuary embalmed Richard’s body, it sent his remains back to England.

Upon receipt of his body, Boorman contends that the English authorities opened up Richard’s body cavity to discover that all the internal organs had been removed and replaced with a rolled up cloth sheet. To date, Richard’s organs have not been located."

The Importance of an Order for Temporary Custody

When you have a child and you are looking to have physical custody of your child, and the other parents is not in agreement on the sort of custody arrangement, often the court will set the matter for trial to determine what the final custody arrangement should be. However, before the trial, temporary custody has to be determined. The court generally gives joint custody to both parents unless one parent cannot spend enough time with the child, or, one parent has committed domestic violence.

This interim custody arrangement gives both parents an opportunity to figure out whether they truly want to fight each other at trial. Going to trial is expensive, time consuming, and stressful. The judge may not give the parties what they want. It is wise, therefore, for both parents to work out a permanent custody arrangement prior to the trial. The temporary custody order will allow both parents to consider the amount of time they can have with their child given work or school schedules.

Many laws can be contracted around by parties entering into a contract. In those cases, the law is considered a default provision. If a contract fails to mention something that a law provides, then the judge uses the law to decide the matter. In addition, if a contract has a provision that is illegal and needs to be struck from the contract, then the law is examined to fill the gap in the contract. An example of default laws come into play with Wills. If you die with a Will, then the court does not have to look at the law to determine how your estate will be distributed. If you die without a Will, then the court must look at the law to determine who your heirs should be and then distribute the assets, as the law requires.

Well, in divorce proceedings, the mother and father will many times prepare a settlement contract in which they address many provisions, such as child custody and visitation, spousal support, and child support. One couple, Fernandez, wrote in their settlement agreement that the father would pay a certain amount of child support and the amount could not be modified. Later, the father fell on hard times financially and sought to modify his child support downward in the court, using Nevada Revised Statute 125B.145. However, the woman judge in charge declared that Mr. Fernandez could not do this because he had an agreement with the mother that he should not modify the support. The judge thought that NRS 125B.145 ought only be a default law.

The father appealed to the Nevada Supreme Court, via his attorney Radford Smith. The Supreme Court reversed the lower court and said that the Nevada Revised Statutes did come into play and a settlement agreement involving child support could not always supersede NRS 125B.145. Thus, the child support statutes can only be “contracted around” to a point. If the parties experience a “material change in circumstances,” then they have the right to go back to the District Court for modification no matter what the contract says. In other words, do not count on a contract for child support to be the final say on the paying parent's obligations.

Any contracts involving child custody that you may want to enter should be reviewed by a competent family law attorney who will tell you what the law is and how solid the contract will be when examined by a judge.

Many people believe they can just start a business without government oversight, however in the State of Nevada, this simply is not so. Because Las Vegas has had trouble with organized crime in the past, several government agencies are involved in every business. Furthermore, because Nevada does not have a state income tax, municipalities raise capital with users fees (which are essentially taxes disguised as application/licensing fees). I recommend complying with the laws because it is considerably less expensive to pay fees on the front end than fines on the back end.

Almost every successful business has a team of professionals available at all times. It is wise to retain a good business lawyer, business bookkeeper, accountant, and financial adviser. For many, it is also wise to retain a marketing expert.

Even the smallest business run out of the home has to be licensed. This goes for E-bayers and Multi-Level Marketers as well. Below are the laws (as of January 22, 2010) concerning business licensing for the various jurisdictions a prospective business person should know about:

Nevada Jurisdiction:

Nevada Revised Statute 360.780 State business license required; application and fee for license; activities constituting conduct of business; participation in exhibition. 1. Except as otherwise provided in subsection 7, a person shall not conduct a business in this State unless he has a state business license issued by the Department. […]

Clark County Jurisdiction:

Clark County Code: 6.04.010 – License required. It is unlawful for any person, firm, association, partnership or corporation, to commence, carry on, engage in or continue (including the making of deliveries of goods, wares, and merchandise sold elsewhere) in the county, outside the incorporated cities and towns, both within and without unincorporated cities and towns, any business, trade, occupation or employment upon which a license tax is imposed by the terms and provisions of Titles 6, 7 or 8 and for which a license tax is required to be procured by the terms of Titles 6, 7 or 8 without first paying such license tax and procuring such license as hereinafter provided.

Las Vegas Jurisdiction:

Las Vegas Municipal Code 6.02.060 – Business license required. (A) It is unlawful for any person to: (1) Commence, institute, advertise, aid, carry on, engage in or continue in the City any business without a valid unexpired license issued pursuant to this Code; (2) Cause, encourage, allow or permit another, on that person’s behalf, to commence, institute, advertise, aid, carry on, engage in or continue in the City any business without a valid unexpired license issued pursuant to this Code; or (3) Commence, institute, advertise, aid, conduct, manage or carry on, either permanently or temporarily, any business of any other person if the person who commences, institutes, advertises, aids, conducts, manages or carries on such business knows or should know that such other person is not licensed under this Title to commence, institute, advertise, aid, conduct, manage or carry on such business.

North Las Vegas Jurisdiction:

North Las Vegas Municipal Code 5.02.020 – License required. No person may conduct any business for which a license is required without first paying such license fee and obtaining and thereafter maintaining a license as hereinafter provided.

Henderson Jurisdiction:

Henderson Municipal Code 4.04.020 License required. A. It shall be a violation of the provisions of this title for any person to commence, carry on, engage in or continue in the city any business without first obtaining a license and paying the appropriate license fee as provided by terms and provisions of this title. […]

FAMILY: Nevada Family Law. How to Determine what Child Custody is Best

My family law clients often do not know the options available under the law for child custody, and when they become informed about their rights, they can then make a good choice. The steps below will assist in determining what custody arrangement would be best for your situation.

1. Can you be in your child's life all of the time?

If you can and want to be in your child's life all of the time, then you can pursue "primary physical custody" or "sole physical custody." However, primary physical is usually easier to obtain and you will get child support. If you seek sole physical custody, then you are seeking to terminate the other parent's rights, which is difficult, and will also eliminate child support. If you get primary physical custody, then the other parent will have visitation rights. NOTE: If you wish to relocate out of Nevada with your child, you have to have primary physical custody. NOTE: If you already have a child custody order from another State and you have moved to NV, you may want to domesticate that order to protect your rights. Contact a family lawyer about this.

2. Can you be in your child's life only some of the time?

If you are unable or unwilling to be in your child's life all of the time, then you can either allow the other parent to have primary physical custody, leaving you visitation rights. If you choose this option, you will have to pay child support. If you can spend more time with your child, then you should seek "joint physical custody" in which you would share your child half the time, or nearly half the time, with the other parent. This works well if the parents live near each other and the child can easily attend school form either parent's house. In "joint physical" custody situations, there may or may not be child support obligations depending on the incomes of both parents. NOTE, "joint physical custody" is the preferred custody under the law. NOTE: All custody decisions are decided by "the best interests of the child" standard.

FAMILY: No Common Law Marriages in Nevada

Some States recognize "common law" marriages. Common law marriages occur when two people of the opposite sex have lived together as husband and wife, but have never officiated their relationship through license and ceremony. Nevada does not.

Recently, the Nevada Supreme Court was asked to review a property dispute that was brought by one member of a couple in family court. The family court exercised jurisdiction over the dispute, however family court did this in error because family court does not have jurisdiction over non-family matters. The Supreme Court stated,

"None of the proceedings set forth in NRS 3.223 concern actions between unmarried, childless parties who used to live together and who dispute the division of property allegedly acquired during their relationship. Thus, because the Legislature has not designated real and personal property disputes between unmarried, childless parties as matters within the family court’s jurisdiction, we conclude that the family court lacked subject matter jurisdiction to consider the merits of Malik’s complaint, and therefore, the default judgment granted by the family court is void."

FAMILY: Children's Temporary Absences from Nevada does not Destroy Jurisdiction in Custody Matters

Nevada Revised Statute 125A.085 clearly states that Nevada courts only have jurisdiction to determine initial custody issues if Nevada is the child's home state, meaning the child has lived here continuously (except for temporary absences) for at least six months prior to the filing of the motion or complaint seeking to establish custody.

HOWEVER

The Nevada Supreme Court, which is supposed to interpret and clarify confusing law, has just done the opposite of the job they are supposed to do. The Nevada Revised Statute was pretty clear, but thanks to the Supreme Court's decision in Ogawa, it is now not so clear at all. In Ogawa, they decided that "temporary absences" of a child from Nevada within the six months prior to the filing of the paperwork did not destroy Nevada's jurisdiction over the child--even if the temporary absence is a long absence.

Now, a logical person would say, ok, a temporary absence could be when a parent takes a child out of Nevada for a couple of days on a road trip but still calls Nevada the home state. Fine! That seems reasonable.

Not so!

Our robed justices decided that a three month absence can still be temporary. That's half of the six month period!

Moreover, in Ogawa, the Supreme Court even declared that the absence of the child for nine months before the filing did not destroy jurisdiction, if the parent that prevents the child from being in Nevada did so for the purpose of destroying jurisdiction. Isn't intent kinda hard to prove? Isn't intent the reason we have juries decide difficult cases, because it is hard for just one judge to look at someone and decide what the person's hidden motives are?

Ogawa is another example of the court destroying a bright-line rule in favor of a rule that is blurry, gray, and confusing. It seems to be the intent of the Supreme Court to give more discretion to the lower courts, rather than have them follow clear guidelines. This ruling is bad for the pocketbook of parties to a custody battle, but great for the pockets of their attorneys. Don't shoot the messenger! Hire me instead.

Chinese Acrobats were NOT Slaves in Las Vegas

Two authors recently published a book entitled, The Slave Next Door, Human Trafficking and Slavery in America Today. They wrote a chapter entitled "New Business Models," which features the Chinese Acrobat slavery case in Las Vegas, in which I defended in federal court one of the accused, a partner of the company that was responsible for ensuring 20 acrobats would get to see the United States safely while performing in public schools all over the country. Scientist Crime Fighter Dispels Superstitious Nonsense on Christmas

How fitting for an intelligent hero (Sherlock Holmes) to emerge in theaters on Christmas to dispel silly superstition. Guy Ritchie did a great job portraying this master detective based on the actual Doyle stories and did not rely on the old Holmes movies. In other words, this movie was a good adaptation, not a remake ten times over. He made Holmes more than an armchair detective and focused on the crime fighter that Doyle intended.

I especially enjoyed the visuals, including London with its filthy unpaved roads and the flat at 221B as it probably should look with two bachelors living there, especially with one having an intensely curious mind. I liked how the movie focused on Sherlock’s ability to fit in with criminals as well as his ability to fight—both of which are hinted at many times in the fifty plus stories written by Sir Arthur Conan Doyle. I like too how Ritchie dispensed with the curved pipe and deerstalker hat, neither of which really is mentioned much in the stories. The violin was a big part of Holmes' stories, and I like how he strummed the instrument in the movie while thinking about his cases. Something a thinking person would do.

Holmes could have used the newsies in this movie like he did in the stories, but maybe that will be left for when he takes down Moriarty in the sequel. Maybe this will be a "threequel" because Moriarty is supposed to kill Sherlock in Switzerland, which would be a good cliff-hanger to move into the third movie (literally since Sherlock and Moriarty are supposed to die while throwing each other off a cliff into a huge waterfall).

Finally, this was cast in an interesting way. The actor who played Lord Blackwood (Mark Strong), and even Jude Law, have physical features more identifiable with Holmes and they may have thought they were going to play the role when hired for the film. Instead, Ritchie cast an unlikely actor, American Robert Downey, Jr. This worked because Downey comes across as a mind that it always busy. Downey might also relate to Holmes’ drug addiction, which was not shown in this movie but is hinted at (sloppy apartment, disheveled appearance, experiment of drugs on dog, bored when not working, etc.)

The music in the movie was up-tempo and musical, suggesting a busy mind. The plot was a lot like the plot of The DaVinci Code, but the feel was right for Holmes. One of my favorite aspects of the Holmes’ stories was that there was always a mystical element thrown in (like X-Files). Doyle was a spiritualist and brought a certain otherworldly darkness to the mysteries, until Sherlock’s keen brilliance illuminated all the swindles and schemes, just as he did in this movie.

Critics who do not like the movie usually say that it is not in keeping with Holmes and that Sir Arthur Conan Doyle would not recognize his hero. I disagree. Critics with these views base their opinions on older movies which were also based on older movies. If you want another good Sherlock Holmes movie that is more true to the original stories, watch "The Hound of the Baskervilles." These movies have tension between Holmes and Watson, which add an element of intrigue.

How to Befriend a Good Lawyer who will Treat you Right

Inexpensive does not equal bad and expensive does not equal good. People who charge a lot for their services have a high opinion of their worth, or a low opinion of your judgment, or have to because they are debt ridden (which should make you wonder at their judgment). Sometimes you will find honest people who are good at what they do and are not so expensive. Likewise, you will find expensive people who are also good at what they do. But many times you will find expensive people are not so good—they just pretend well. Words of wisdom.

Winning in court should be about justice, not about how much you pay. True, if you hire a specialist and pay a lot, you will likely get favorable results in the courtroom, even if you end up broke. Look at the dream team at OJ Simpson’s murder trial, if you want an example. He paid a lot for famous lawyers. He was acquitted and became broke. Did OJ get justice? Did California?

Then look at Leandro Andrade. He was a petty shoplifter in California who was caught shoplifting children’s videos before Christmas in two different K-marts. Normally misdemeanors, these crimes were escalated to felonies because of his prior non-violent and petty criminal record. Then, the felonies were turned into his third and fourth strikes under California’s three strikes law. He did not have money to hire good lawyers. He was sentenced to a minimum of 50 years in prison and a maximum of life for shoplifting. Here again, we have to ask, was justice served? One has to wonder, would Leandro have been treated so harshly if he would have had OJ’s lawyers—or any lawyer worth a damn or who gave a damn?

America is a land of laws. We are subject to the rule of law. Lawyers are the soldiers in the fight for justice. More important than any dollar amount you pay to your lawyer is how you are treated and what you will get in the end. Does the lawyer respect you? Does the lawyer give you sound advice? Return calls? Or does the lawyer pretend to never be at the office, refuse to give you any free legal advice, and has secretaries call you back to answer your questions and yet still charge you over $300 per hour. Likely you are also paying over $150 per hour for a secretary/paralegal/law clerk to talk to you on the phone.

Does your lawyer tell you what your options are and then let you decide your fate? Or does the lawyer just do whatever the lawyer wants and keep you in the dark? Does your lawyer honestly tell you his/her experience in dealing with the issue you have brought, or does the lawyer look uneasy and then lie to your face? Does your lawyer explain the Fee Agreement or Representation Agreement to you and let you know that you can have still another attorney review it since it is a legal contract between you both? Or does the lawyer just have you quickly sign a bunch of papers without giving you time to read and understand your rights and duties under the contract?

I do not mean to be so harsh on my fellow attorneys. I have many who are friends. But, I know far too many who sit in a soft chair all day, get fat, bill their clients exorbitantly and then buy houses and cars they have no time to enjoy because they are too busy making more money to pay for everything. Then, they get sick. They get heart attacks or cancer. They buy great health insurance with the money they earn from clients and hope to survive to return to making money at their firms. I am not bitter at those attorneys at all. I just decided their way of life was not my way. I looked for other attorneys that I could respect and learn from. I found them.

I know a few excellent attorneys who actually care about their clients. They want to make a living and also want the people who trust them to like them and come back for other matters. Yes, most of them charge more than I do, but often times they do a lot of work for free too. These attorneys enjoy the law not because it makes them a fortune, but because it allows them to live a healthy balanced life. Instead of getting rich, they spend time working out, raising families, and enjoying their freedom all while working to ensure their clients can also enjoy the pursuit of happiness for which America stands.

The attorneys that I know and would trust with my legal issues generally do not work for big firms and usually run their own practices. They do not advertise on television or have big billboards. They are grounded, down to earth people whom you would probably like to have as friends. If you want to make friends with an attorney like this, it is simple--send them business, yours, and other peoples. Buy them lunch once in a while to discuss your case. They will appreciate it and you may be invited to dinners or parties or get inexpensive legal assistance in the future.

FAMILY: Court Costs are Expensive for Divorces, Beware of False Ads

Beware of advertisements wherein someone tells you they will handle your divorce for a couple hundred dollars. That is virtually impossible to do. Let me explain.

To file for divorce in Clark County, Nevada (Las Vegas, Henderson, North Las Vegas, Boulder City) the current filing fee is $289.00 (November 2009). Add several more dollars to that for copying costs. Then, you will have to have a process server serve your soon to be ex. If you go with a professional server (recommended) it will cost a minimum of $50.00.

As you can see, the filing and service costs alone exceed $300.00. If an attorney says that he will handle your no contest divorce for $250.00, you should know that that is just his/her fee and does not include any court costs. Make sure you question your attorney regarding all the potential costs.

If it is a paralegal or some other person who wants your money to prepare paperwork, get away and contact a real lawyer, otherwise you will be giving money to someone who has no authority to practice law. Very costly mistake.

The good news is that the Nevada Supreme Court has adopted a new rule intended to save clients money in civil case, including family cases. This rule is especially relevant to people who live outside of Reno or the Las Vegas Valley but need attorneys from those areas. Essentially, the rule is that lawyers may appear by telephone or video-conferencing on your behalf in court for certain parts of cases. This saves you tremendously! Not only will you not have to pay the travel costs of the lawyer (i.e. plane ticket, mileage) to go to court, which are usually always paid by the client, but you also will not have to pay for the lawyer’s time in traveling. If your lawyer has not made you aware of this new rule, that lawyer either does not know the rule, or is not concerned with saving you money. Do not be afraid to ask. CRIMINAL: 55 year old gets 12 years in prison for defending himself and a woman against a boxer half his age

In response to Judge Barker's sentence of 12 years in prison to Michael Chambliss, reported at: http://www.lvrj.com/news/ex-civic-leader-gets-12-years-64067377.html

Chambliss' actions seem like a clear-cut case of self-defense or defense of others. A boxer, half Chambliss' age, attacked a woman and then shoved Chambliss around. Clearly Chambliss met this vicious and potentially lethal attack with at least equal force. I would like to think that a jury would have exonerated him. I think Judge Barker could have given him a much lighter sentence--such as probation.

Men should respect their elders and not hit woman, especially when their own hands could be considered deadly weapons. I'm confused that Chambliss gave in so easily and plead guilty to voluntary manslaughter. He was evidently afraid of trial and perhaps afraid of juries.

Did the boxer deserve to die? No. Does Chambliss deserve this severe of a punishment for standing up for a woman and himself against a guy half his age that could have torn him apart? No.

I hate what this story means. It means that an elderly person can be charged with murder or manslaughter for using a knife on a young person who is the primary aggressor.

CRIMINAL: My Mother Killed my Step-Brother Thirty-two Years Ago! No SOL on Murder.

There is no Statute of Limitations for murder. In 2007 a Nevada jury convicted a step mother of killing her three-year-old step son 32 years before. Following the conviction, the step-mother, Wyman, appealed to the Supreme Court. One of her arguments, was that 32 years was too long of a delay to charge her with murder. She argued that the delay was intended by the State to gain a tactical advantage over her and that it prejudiced her.

The State had new evidence to charge her, which they did not have when the murder occurred. You see, Wyman’s own daughter, Dunn, grew up and had emotional scars because she witnessed the murder. As a young girl, she saw Wyman kick her three-year old step-brother to death and then later claim that the child fell off a chair. Dunn just never said anything until she started counseling for psychological issues. As a result, Dunn’s memory was enough to charge and then convict Wyman.

PERSONAL INJURY: Nevada Casinos are not Responsible for Drunk Kids who get in Accidents after being Kicked off Casino Property

When a drunk 17 year old acts rowdy at a Nevada casino and is compelled to leave, can he sue the casino when he gets in a car wreck because he is drunk? More importantly, can he win?

The answer to the first question is that he could sue since his lawyers were trying to convince the court that a casino ought to be negligent for evicting a drunk 17 year old. Since the lawyers were trying to expand Nevada law, their lawsuit was not considered frivolous by our justices in black robes. In other words, the lawyers were trying to carve out an exception to Nevada’s lack of dram shop laws.

However, since Nevada does not have dram shop liability laws that allow people to sue taverns or casinos when they get in a wreck after driving, this 17 year old lost his case in District Court on summary judgment and lost again at the Supreme Court. The Supreme Court did not agree that minors should be the exception. We Nevadan’s don’t want our biggest industry, the gaming industry, to be sued every time some drunken fool gets hurt or hurts someone.

After this decision, lawyers probably ought not try to sue under this legal theory in the future. Trying the first time could be considered “attempting to expand Nevada law” but trying again could be considered frivolous.

FAMILY: Las Vegas is a Great City to move to for Divorce

The US Census Bureau has just published the statistics that show Nevada has a 14.2 % divorce rate, the highest in the United States. Others may blame gambling, alcoholism, and other temptations for Nevada’s high divorce rate amongst residents, and certainly those may be contributing factors, however I believe that Nevada has the highest divorce rate in the Nation for other reasons.

One other reason for the high divorce rate, besides blaming Nevada’s industry, is that the nationwide economy has hit Las Vegas hard. Nevada’s real estate values took a nosedive. Homes that were selling for a half million dollars a few years ago are selling for a quarter of that, or less, now. Manipulation of interest rates, unscrupulous lenders, and real estate buyers that did not understand their own mortgages and the impending bubble burst, has caused a tremendous financial crisis for many families, putting stress on marriages to the point of divorce.

But, I don’t even blame that for Nevada’s highest divorce rate. I believe that Nevada consistently has a high divorce rate because our laws make divorcing here easy. Other States want to force people to be legally married for months, or even years, after the couple decides it ain’t working. Those States do not value freedom of association or privacy very highly. The governments of those States believe that they have an interest in your marriage and want to make your divorce difficult. This is one reason many States require blood tests and publication of notices prior to marriage.

Folks in the know, who can, move to Las Vegas to get divorced. You have to become a resident here in order to do so, but that is easy to do. You simply must live here for six weeks with an intention to remain indefinitely. You must show the court some paperwork that suggests this fact when you file for divorce. Only one person of the divorcing couple needs move here, and can live in a weekly or a month-to-month dwelling. If there are no children involved, and very little property to fight over, the divorce is swift, inexpensive, and relatively noninvasive.

FAMILY: How to Potentially Save Your Life and the Lives of Others without doing Much

Pet cats benefit society in many ways. They provide companionship. They reduce stress and actually contribute in some ways to better health. Their products sold at departments stores contribute to the economy. They hunt rodents and insects in homes during the night while their humans are sleeping and oblivious to the poisonous insect that could bite them. They alert you to dangers in the home, such as fires.

What do we humans do in return to the love and attention these little pets give us? We allow them to overpopulate so that we are forced to kill kittens. Every day, thousands of garbage cans across the United States are stuffed full of the carcasses of cats and kittens that have been euthanized.

The solution to this unnecessary killing is simple and not very expensive. People only have to care enough to spay and neuter the cats that come into their lives. If you see a stray and start feeding it, take it to a vet and make sure it has been altered. If it costs too much at one place, try another, or find a charitable organization that accepts donations.

What you should not do is feel that it is someone else’s problem. When a cat enters your life, you ought to be thankful that someone cares enough about you to visit you and you can reciprocate by making sure the cat’s basics are met, namely that it has been altered, has its vaccinations, and is fed and watered. Very simple, very inexpensive.

If, however, you believe it should be someone else’s problem and you bring a litter of kittens into a "no kill " cat rescue expecting that the rescue volunteers will be nice to you, do not kid yourself. Volunteers at cat rescues love cats, but they begin to despise humans fairly quickly because more humans dump cats off without donating any time, money, or other resources. Too few are willing to sacrifice even a little for cats and kittens, and those few are overextended. Do not expect volunteers who are already going above and beyond to assist you if you are not even willing to sacrifice a tiny bit.

Next time you are in a PetsMart, or see a cat rescue volunteer, the kindest thing you can do is thank them and hand them $5.00 (or more) to help defray the costs of the medical bills. And remember, if you plan to adopt a cat from a rescue, the cost you pay for the adoption fee is not a sales price for the priceless cat, but simply a reimbursement of the cost that the rescue incurred to have the animal altered and vaccinated. The love and attention of the volunteers and even food that has fed the cat while the cat is at the rescue really is not even included in the adoption fee. That is all from voluntary donations.

If you are in Las Vegas and can foster a cat, Purrfect Friends really needs your help. Because of the downturn in the economy and the collapse in the real estate market, people have abandoned their homes and their cats. Right now, a spare bathroom or bedroom in your house could help save up to three cats. Fostering means that you would care for the cat(s) for as long as you can or until someone adopts.

Remember, that little cat that you help save, could help save your life or some total stranger’s life one day, and you’ll never even know.

CIVIL/CRIMINAL: Rape is Different when it’s about Money than when it’s About Crime.

In Nevada, criminal courts do not allow defense attorney to force victims of rape to discuss their sexual history. Defense attorneys would love the opportunity to attack the victims of rape. If a victim has had a lot of sex with a lot of people, well then, maybe the victim was not really raped. Maybe the victim was not the victim. Maybe the accused rapist is the victim. This is the logic that Defense attorneys would love to argue in criminal cases to get their clients off.

Nevada law won’t allow it. We Nevadans believe that victims of rape should not again be traumatized on the witness stand in criminal court. Heck, victims of rape may not even come forward if they know that a jury, and their parents will learn about their sexual history. In other words, the criminal defendant does not get the right to attack the victim’s sexual morality—all the while the Defendant’s sexual morality is called into question. We call this a “rape shield” law. Seem fair to you?

However, the Nevada Supreme Court has just clarified that the rape shield law does not apply to civil cases. So, if a rape victim decides to sue the rapist for damages, for instance for emotional distress, well—in that case the victim’s sexual morality can be called into question. Seem fair to you?

Let me see if I understand the distinction. We don’t allow a criminal defendant who is looking at years of imprisonment to provide evidence in court that says, “But she was leading me on—she had a reputation of sleeping with guys like me. In fact, three of my buddies just had sex with her the night before and they said that I would be next.”

However, a civil defendant being sued for rape, where only money is the punishment, and not imprisonment, CAN provide such evidence in court.

Do we really care more about money than we do about liberty? Should the “rape shield law” exist? If so, should it be used in all cases, not just criminal.

Well, the Supreme Court did think a little about these questions because it stated that, even though rape shield does not apply in civil cases, “[n]onetheless, we conclude that if necessary the district court may limit the discovery of an alleged victim’s sexual history under NRCP 26 to protect the victim’s interests.”
