You may ask the question, “What is an order for temporary custody in Las Vegas?”
I have often been asked what can be done immediately when a parent needs to take control of a child. Sometimes fathers call me and tell me they do not have any custody rights because they never established paternity, but the mother is in trouble somehow and custody with father is the only option and it has to be done soon.
Sometimes mothers call me and tell me their husband is not in the picture but will pretend to want to be so that they can get preferential custody and avoid child support—but the mother needs the child support immediately to survive with the child because the father, who was the provider, is no longer providing.
The answer, of course, is to move toward getting a permanent custody order, which can take months.
So, when you have a child and you are looking to have physical custody of your child, and the other parents is not in agreement on the sort of custody arrangement, often the court will set the matter for trial to determine what the final custody arrangement should be. However, before the trial, temporary custody has to be determined. The court generally gives joint custody to both parents unless one parent cannot spend enough time with the child, or, one parent has committed domestic violence—or other factors would suggest the joint custody is not in the best interests of the child. More over, if the father has not established paternity, this must be done first or the court will not give the father custody since the court does not know for certain whether the party is the father.
The court can order temporary shared custody, temporary joint physical custody, and temporary primary physical custody based on the arguments presented and the best interests of the child or children. Sometimes the court is unwilling to make an order until the parties have mediated first.
This interim custody arrangement gives both parents an opportunity to figure out whether they truly want to fight each other at trial. Going to trial is expensive, time consuming, and stressful. The judge may not give the parties what they want. It is wise, therefore, for both parents to work out a permanent custody arrangement prior to the trial. The temporary custody order will allow both parents to consider the amount of time they can have with their child given work or school schedules.
